Surviving and Thriving as a Patent Attorney
Every freshly minted patent attorney should receive from the PTO, in addition to that cheesy certificate of registration, two nicely framed pieces of paper. One of them would be emboldened in large letters:
"Watch yourself; it's a hard world out there."
We give you lots of practical advice to help you do just that. Take the course to learn what the other framed paper says.

Abandonment and Revival - Death and Rebirth
Patent applications are like goldfish. Make the slightest mistake in their care and they die. The good news about a dead patent application is that it can almost always be revived by paying the PTO a pile of money. The bad news is that the pile required is huge, and usually has to be paid from your pocket. In this course, there are lots of suggestions for minimizing abandonments, and how to revive dead applications as quickly and stress free as possible.

Can You Spot the Mistakes? (No. 3) Twelve More Serious Patent Attorney Errors for You to Find
That lovable bumbling patent attorney Robin Winslow is back for a second sequel, this time telling a truly frightening tale of what happens when bumbling patent attorney meets The Mob. We have all seen The Godfather, and Tony Soprano is someone we all sort of admire. But The Don who is Robin's client this time is all too real, and Robin ends up with a big mess to dispose of. In the process you will find lots of instructive errors and lessons for every patent attorney.

Can You Spot the Mistakes? (No. 4) Sixteen More Serious Patent Attorney Errors for You to Find
In this fourth tale of incompetence, Robin tells us about a client that was definitely scary, perhaps one you too will find frightening. We all have a sort of half-belief in the creatures that we met in dark movie theatres in our childhoods, Frankenstein, Dracula, and many more. Robin this time has a client who doesn't come out in the daylight, and who may or may not be a threat. This one definitely is not a tale for the faint hearted.

Can You Spot the Mistakes? (No. 5) Sixteen More Serious Patent Attorney Errors for You to Find
Robin is back, as bumbling and entertaining as usual. This time Robin tells us about a client that Robin will never forget, and perhaps you too will find memorable. You too will love Benny and mourn his fate. And learn lots from what Robin doesn't do. Will the mistakes never end?

Chapter 10 of 37 CFR - The Patent Attorney's Ten Commandments
In a just and perfect world, a patent attorney who is honest and tries to do the best in his life and practice would have a safe and successful practice, but that is not the world in which we practice law. Rather, it's a dangerous place, getting more dangerous every day. Our universal objective of making it to retirement with reputation and pension intact becomes more of a challenge each year. Now, more than ever, knowing and following closely the PTO ethics rules is the beginning of a successful strategy to accomplish that goal. 37 CFR sets for the basic rules for prosecuting patents in and out PTO. Chapter 10 of 37 CFR lays out the basic rules of ethics for patent attorneys and basically tracks the ABA model rules. They are "must know".

Claim Drafting 101 - An Introduction to the Art of Writing Claims
To succeed as a patent prosecutor you have to master two difficult tasks the drafting of a claim that is, on the one hand, just narrow enough to be patentable, and, on the other hand, is just broad enough to ensnare everyone who wants to use the invention, and the creation of an argument that will result in an examiner agreeing that these claims are not obvious under 35 USC 103. For the next hour, we begin your journey from claim drafting novice to expert. Be warned that you won't make it for many hours; this is just the beginning.

Critique and Consequences of the Supreme Courts
Based upon an article by Kenneth C. Bass, III and Linda E. AlcornSterne Kessler Goldstein Fox.
The Supreme Court Decision in Holmes Group, Inc. v. Vornado Air Circulation Systems, Inc seems both narrow and right, but there is a fascinating tale here. First, Justice Scalia who wrote the opinion just blew it. Second, the law of unintended consequences is fully at work here, as you shall see.

Ethics and Patent Law - An Overview
Patent attorneys answer to two masters their state bar and the patent office. Both have established lengthy rules that govern every aspect of representing a client. Happily, the rules are mostly, if not entirely in harmony and are mostly based on the common sense notion that honesty and fair dealing are required of the attorney in all his or her professional actions. However, there are a number of unique ethical issues involving patent law, and we discuss these in detail.

Patents, Ethics and Conflicts - The Fatal Choices
Of all the decisions that you make almost every day in your practice of patent law, the most significant are those deciding whether to accept a new clients, or to refuse the clients, because of a perceived conflict with present or past clients. Making the wrong decision can have the most grave consequences. And yet the decision is often made hastily, sometimes by default, with incomplete facts in hand. Conflicts of interest of all kinds arguably present the most serious legal malpractice threat to law firms of all types, and particularly patent law firms. We look at conflicts caused by two clients with adverse interests, and conflicts caused by an attorney doing business with a client, and examine a court decision that is guaranteed to scare the hell out of you.

Sex and Ethics - Part 2 - More Sexual Harassment Lessons Delivered as Cautionary Tales
We are sexual beings, each and every one of us.
So began the predecessor of this course, Sex and Ethics An Overview of Sexual Harassment. In that earlier course, we explored the reasons why a chasm of opinion exists as to what should be the proper boundaries of illegal conduct, and how that chasm affects what happens in businesses of all kinds. We looked at a number of scenarios and thought about the problems they presented and how might be the best way to approach those problems. In the sequel we continue to examine different stories about issues that arise in law firms, and talk about how they can best be handled. The goal in the first course was more to sensitize you than to try to make you an expert, and that remains the goal in this sequel.
