Due Dates - Part 1 - The Labyrinth Explained
In a rational world, every communication from the PTO would state in bold letters when a response is due, if at all, what extensions are available and how they are obtained. But of course the PTO provides none of the above, perhaps just to create some interest for bored patent attorneys, but more probably because the due date rules now have grown so complicated that no one at the PTO is prepared to make such determinations. Better to leave the calculations to the attorneys and then extract punishment or payment when they err. Well, you and your staff can master these rules and get that due date right every time. And if you dont, expect to be paying your lunch money to the PTO for the foreseeable future.
