Patents are always in the end about money. Either they keep competitors out of the market, allowing for prices to be higher than they otherwise could be, or they are used to extract money from those who arguably are infringing the patent. But what constitutes infringement? It is not as easy a question to answer as you might think, and Dale provides an excellent summary of the basic law, with illustrations from most of the important CAFC cases. In this first part, Dale discusses direct infringement.
